API Terms of Use
This document sets forth the terms and conditions on which The World Bank Group ("The World Bank") makes the World Bank API (defined below) available for use by approved licensees on other approved Web sites and applications. By using the World Bank API, the user and the organization identified in the user's application for the World Bank API ("you") agree to be bound by the following terms of use ("API Terms of Use").
1. World Bank API
The World Bank API is The World Bank's service that allows approved licensees to retrieve and use certain content and data provided by the World Bank ("World Bank Data"). The World Bank API consists of an application program interface (API) for retrieving various World Bank Data, grouped generally into calls to retrieve data found on the World Bank's website (http://www.worldbank.org). The World Bank may release subsequent versions of the World Bank API and require you to obtain and use the most recent version. New versions may not be compatible with previous implementations.
2. License to World Bank API & Data
In order to use the World Bank API you must be licensed by the World Bank (see; http://developer.worldbank.org). If you are approved by the World Bank for use of the World Bank API, and subject to these Terms of Use, you may access the World Bank API, implement the World Bank API on your Web site(s), Application (s) and distribute World Bank Data only to your users for their personal use without charge on your Web site(s) and in accordance with the World Bank API Branding Requirements (defined below). Any commercial redistribution of World Bank Data must be subject to a separate, written agreement with the World Bank. All queries related to commercial redistribution of World Bank Data should be addressed to pubrights@worldbank.org.
The license is subject to the following restrictions:
All calls to the World Bank API must reference the APIKEY issued to you as an approved licensee.
You agree that you will provide the World Bank Data to users on an "as is" basis, with disclaimers substantially equivalent to those set forth in Sections 7 and 8, below.
You agree to keep the APIKEY confidential, and not to share it with any third party. This license is personal to you, and any affiliates or third parties must seek and obtain their own license and APIKEY.
You may not retain any copies of the World Bank Data. Your license is limited to making direct server calls to http://open.worldbank.org for purposes of distributing World Bank Data to your end users on your Web site(s) and/or Application(s) immediately upon receipt by your servers.
You may not present the World Bank Data (or permit World Bank Data to be presented) so that it appears to be available from a third party or third party Web site.
You further agree not to otherwise reproduce, modify, distribute, decompile, disassemble or reverse engineer any portion of the World Bank API or any World Bank Data provided by The World Bank.
You may not use the World Bank APIs in a manner that exceeds reasonable request volume, constitutes excessive or abusive usage, or otherwise fails to comply or is inconsistent with any part of the World Bank API documentation located within http://developer.worldbank.org, as determined by the World Bank in its sole discretion.
You are limited to one thousand (1,000) calls to the World Bank API per day. The World Bank may approve higher daily call limits if you adhere to these API Terms of Use and pass a World Bank audit and review. Please contact the World Bank at apifeedback@worldbank.org for more details.
You may not use the World Bank APIs in connection with or to promote any products, services, or materials. You specifically acknowledge that the World Bank is not liable for any conduct of any of your users.
You may not use the World Bank APIs in any manner or for any purpose that violates any law or regulation, any right of any person, including but not limited to intellectual property rights, rights of privacy, or rights of personality, or in any manner inconsistent with the World Bank's Terms of Use, Privacy Policy or these Terms of Use.
If you become aware that any user of your implementation is in material breach of these API Terms of Use, any provisions you are required to offer under these API Terms of Use, the World Bank's Terms of Use or the World Bank API Branding Requirements (the "Applicable Terms"), then you agree to notify the World Bank promptly of such breach by e-mail to apifeedback@worldbank.org , and to take prompt commercially reasonable corrective action at your expense to remedy such breach. In addition, upon request of the World Bank, you will either (a) use commercially reasonable efforts to obtain such equitable relief to prevent harm to the World Bank or its licensors, or (b) assign any of your applicable rights to permit the World Bank or the applicable licensor to seek such equitable relief. Your obligations to report and enforce the Applicable Terms will survive termination of these API Terms of Use or your use of the World Bank API.
Any and all limitations, conditions, disclaimers whatsoever applicable to any World Bank Data accessed through the World Bank API apply to such data regardless of such data being accessed through the World Bank API.
3. Branding Requirements - World Bank Logo & Links
* Service Description. When deploying or utilizing World Bank Data on your site or within your application, you agree to display the Powered by the World Bank logo. If World Bank Data is used to create a graphical representation, the Powered by the World Bank logo needs to be present within or adjacent to the graphic.
* Service Icon/Logo Display. When deploying or utilizing World Bank Data, you agree not to make any changes to the shape and size of the Powered by the World Bank logo. Other than including this attribution to the World Bank, you must not use any World Bank trade marks or logos, including the World Bank name, without the written permission of the World Bank.
* Service User Interface Display. When a reader clicks on the Powered by the World Bank icon logo you agree to hyperlink that logo directly to the World Bank home page at http://www.worldbank.org .
4. Acceptable Use
You agree not to use the World Bank API, World Bank Data, or World Bank Brand & Links in any way that is unlawful, or harms the World Bank, its service providers, its suppliers, your end users, or any other person. Further, pursuant to Section 12 below, the World Bank may terminate your use of the World Bank API, World Bank Data and World Bank Brand & Links if and when the World Bank determines that your use is inappropriate.
5. Limited Relationship
You and the World Bank are independent contractors, and nothing in these API Terms of Use shall be construed as creating an employer-employee relationship, a partnership, agency or fiduciary relationship or a joint venture. While you may publicly refer to the fact that you have implemented the World Bank API, you agree not make any other public statements that assert or imply any other relationship with the World Bank, unless you have the World Bank's prior written approval. Neither the name of the World Bank nor the names of its contributors may be used to endorse or promote products derived from the World Bank API without specific prior written permission of the World Bank.
6. Indemnity
You agree to hold harmless and indemnify The World Bank, and its subsidiaries, affiliates, officers, agents, employees, and suppliers, from and against any third party claim arising from or in any way related to your or your users' use of the World Bank API or World Bank Data, use of the World Bank Brand & Links other than as set forth in the World Bank API Branding Requirements, violation of these API Terms of Use or other actions connected with use of the World Bank services, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature. In such a case, the World Bank will provide you with written notice of such claim, suit or action.
7. NO WARRANTY
THE WORLD BANK PROVIDES THE WORLD BANK API, THE WORLD BANK DATA, AND THE WORLD BANK BRAND & LINKS "AS IS" WITHOUT WARRANTY OF ANY KIND , either express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, and non-infringement. The World Bank specifically does not make any warranties or representations as to the accuracy or completeness of any such Materials. The World Bank periodically adds, changes, improves, or updates these Materials without notice.
8. LIABILITY LIMITATION; EXCLUSIVE REMEDY
IN NO EVENT WILL THE WORLD BANK OR ANY DATA OF CONTENT PROVIDER BE LIABLE FOR ANY LOSS, DAMAGE, LIABILITY OR EXPENSE INCURRED OR SUFFERED WHICH IS CLAIMED TO RESULT FROM THE USE OF THESE MATERIALS, INCLUDING WITHOUT LIMITATION ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES ARISING OUT OF, BASED ON, OR RESULTING FROM THESE API TERMS OF USE OR YOUR USE OF WORLD BANK API, THE WORLD BANK DATA, OR THE WORLD BANK BRAND & LINKS, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. USE OF THESE MATERIALS IS AT YOUR SOLE RISK. THE EXCLUSION OF DAMAGES UNDER THIS PARAGRAPH IS INDEPENDENT OF YOUR EXCLUSIVE REMEDY AND SURVIVES IN THE EVENT SUCH REMEDY FAILS OF ITS ESSENTIAL PURPOSE OR IS OTHERWISE DEEMED UNENFORCEABLE. THESE LIMITATIONS AND EXCLUSIONS APPLY WITHOUT REGARD TO WHETHER THE DAMAGES ARISE FROM (A) BREACH OF CONTRACT, (B) BREACH OF WARRANTY, (C) NEGLIGENCE, OR (D) ANY OTHER CAUSE OF ACTION, TO THE EXTENT SUCH EXCLUSION AND LIMITATIONS ARE NOT PROHIBITED BY APPLICABLE LAW. IF YOU DO NOT AGREE WITH ANY PART OF THESE API TERMS OF USE, OR YOU HAVE ANY DISPUTE OR CLAIM AGAINST THE WORLD BANK WITH RESPECT TO THESE TERMS OF USE, THEN YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE WORLD BANK API, THE WORLD BANK DATA, AND THE WORLD BANK BRAND & LINKS.
9. Intellectual Property
The World Bank API, World Bank Data, and The World Bank Brand & Links are the property of The World Bank, and subject to the intellectual property rights of The World Bank and its licensors. © 2008 The World Bank. All rights reserved.
10. Changes
The World Bank reserves the right to change the API Terms of Use from time to time, and you are responsible for regularly reviewing these API Terms of Use. Your continued use of the World Bank API and/or World Bank Data after the effective date of such changes will constitute acceptance of and agreement to any such changes.
11. Fees and Payments
The World Bank reserves the right to charge fees for future use of or access to the World Bank APIs or the The World Bank services and Web sites (collectively, "World Bank APIs Services") in The World Bank's sole discretion. If The World Bank decides to charge for the World Bank APIs Services, such charges will be disclosed to you prior.
12. Termination
The World Bank may change, suspend or discontinue the World Bank API and suspend or terminate your use of the World Bank API, World Bank Data, and/or The World Bank Brand & Links at any time for any reason, without notice. You may also terminate by ceasing to use the World Bank API, World Bank Data, and The World Bank Brand & Links, removing implementation of the World Bank API from your Web site(s), Application(s) and deleting all copies of the World Bank Data and The World Bank Brand & Links.
13. Applicable Law and Jurisdiction
This Agreement will be interpreted and enforced in accordance with the laws of the District of Columbia, United States of America. Any action to enforce this agreement shall be brought in the federal courts located in Washington, D.C.
Preservation of Immunities
14. Nothing herein shall constitute or be considered to be a limitation upon or a waiver of the privileges and immunities of the World Bank, which are specifically reserved.
15. Reservation of Rights
The World Bank reserves all rights not expressly granted under these Terms of Use, and no other rights are granted under these Terms of Use by implication or estoppel or otherwise.
16. General
You represent that you have the authority to bind the organization (if any) identified in your application for the World Bank API. You agree not to export from anywhere any part of the World Bank API, World Bank Data, or The World Bank Brand & Links provided to you or any direct product thereof except in compliance with, and with all licenses and approvals required under, applicable export laws, rules and regulations. If any part of these API Terms of Use is determined to be invalid or unenforceable, then the invalid or unenforceable provision will be replaced with a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these API Terms of Use will continue in effect. The section titles in these API Terms of Use are solely used for the convenience of the parties and have no legal or contractual significance. The World Bank may assign these API Terms of Use, in whole or in part, at any time with or without notice to you. You may not transfer, assign, or delegate your APIKEY to any third party. The World Bank's failure to act with respect to a breach by you or others does not constitute a waiver of its right to act with respect to subsequent or similar breaches.
